Rules and guidelines for using the LLYA marketplace
Introduction
- These Terms & Conditions govern access to and use of the LLYA website, iOS App, Android App, and related marketplace services operated by LLYA Technologies Pvt. Ltd.
- By accessing or using the Services, users agree to these Terms.
- If you do not agree to these Terms, you must stop using the Services.
Eligibility & User Requirements
- Users under 18 may:
- Browse listings
- View items
- Create an account
- Users must be 18 years or older to:
- Buy items
- Sell items
- Receive payouts
- Initiate disputes
- Enter into transactions
- The Services are intended for individual, non-commercial sellers only in Phase-1.
- Business or commercial sellers may be supported in future phases under additional terms.
Marketplace Scope & Categories (Phase-1)
- LLYA supports the resale of the following categories:
- Fashion and apparel
- Accessories
- Supported for:
- Women
- Men
- Kids
- Baby
- Additional categories may be introduced in future phases.
- LLYA reserves the right to restrict, expand, or modify supported categories without notice.
Condition & Item Requirements
- Items must be accurately described and photographed.
- LLYA permits the following item conditions:
- Used items
- New with tags (NWT)
- New without tags (NWOT)
- Sellers must correctly label item condition.
- Misrepresentation may result in disputes, refunds, or enforcement action.
- Items must be clean, wearable, and saleable unless explicitly stated otherwise (e.g., flawed or repair needed).
Prohibited Items
- The following items are prohibited:
- Hygiene & Intimate Wear:
- Lingerie
- Underwear
- Worn swimwear
- Intimate or skin-contact garments
- Counterfeit & IP Violations:
- Counterfeit goods
- Replica or inspired-by branded items
- Trademark or copyright-infringing goods
- Illegal & Restricted Items:
- Stolen goods
- Weapons
- Hazardous items
- Drugs or medical devices
- Non-Fashion Categories (Phase-1):
- Electronics
- Home goods
- Collectibles
- Used beauty and cosmetics
- Food or perishables
- Retail Inventory:
- Commercial stock
- Boutique inventory
- Wholesale goods
- Dropshipping listings
- LLYA may remove prohibited items at its discretion.
Counterfeit Policy (Zero Tolerance)
- LLYA has zero tolerance for counterfeit goods.
- If LLYA determines or reasonably suspects an item is counterfeit, it may:
- Remove listings
- Cancel transactions
- Suspend or ban accounts
- Withhold payouts
- Refund buyers where applicable
- Cooperate with rights holders or authorities
Listing Rules
- Sellers must provide accurate information including:
- Photos
- Condition
- Size
- Brand (if applicable)
- Defects
- Color
- Category
- Off-platform contact, solicitation, or transactions are strictly prohibited.
- Multi-accounting for manipulation, fraud, or evasion is prohibited.
Pricing & Fees
- Sellers set their own item prices.
- Phase-1 monetisation includes:
- No seller commissions
- No listing fees
- Buyers are responsible for:
- Buyer Protection Fee
- Postage and delivery fees
- LLYA may introduce additional monetisation features in future phases.
Payments, Escrow & Payouts
- Buyer payments are held in escrow until transaction completion.
- A transaction is completed when:
- Buyer confirms receipt
- The 48-hour dispute window expires without a dispute
- If a dispute is opened, escrow remains until resolution.
- Seller payouts are issued after completion via supported digital payment providers.
- LLYA does not store full card numbers.
Buyer Protection & Disputes
- Buyer Protection applies to items that are:
- Not delivered
- Damaged in transit
- Significantly not as described (SNAD)
- SNAD includes mismatches in:
- Item
- Size
- Color
- Brand
- Condition
- Authenticity
- Quantity
- Buyer remorse is not eligible for refunds.
- Buyers must open disputes within 48 hours of delivery.
- Evidence may be required.
- Returned items must be in the same condition received.
- LLYA’s dispute decision is binding.
Shipping, Delivery & Returns
- All shipping must use LLYA’s integrated courier services.
- Meetups, cash on delivery, and self-shipping are not permitted.
- Buyers pay postage at checkout.
- Returns are permitted only when a dispute is accepted.
Buyer Protection Fee
- The Buyer Protection Fee is charged at checkout.
- The fee covers:
- Escrow handling
- Dispute resolution
- Refund facilitation
- The Buyer Protection Fee is non-refundable.
User Conduct & Fraud
- Users must not engage in:
- Fraud
- Chargeback manipulation
- Counterfeit selling
- Harassment or abuse
- Platform gaming or evasion
- Fee manipulation
- LLYA may suspend or terminate accounts at its discretion.
Platform Authority
- LLYA reserves the right to:
- Remove listings
- Block transactions
- Hold payouts
- Suspend users
- Request information
- Resolve disputes
- All actions may be taken at LLYA’s sole discretion.
Limitation of Liability
- LLYA is not responsible for:
- Off-platform interactions
- Fit, style, or buyer preference
- User negligence
- Courier delays outside reasonable control
Dispute Resolution
- Disputes must first be handled through LLYA’s in-app resolution process.
- Unresolved disputes may proceed to arbitration in Pakistan.
- If arbitration is not permitted, disputes fall under the courts of Islamabad, Pakistan.
Governing Law
- These Terms are governed by the laws of Pakistan.
Changes to Terms
- LLYA may update these Terms from time to time.
- Continued use of the Services constitutes acceptance of updated Terms.
